North Dakota Man Convicted of Assault
United States Attorney Brendan V. Johnson announced that Joey White Eagle, age 32, of Fort Totten, North Dakota, appeared before U.S. Magistrate Judge William D. Gerdes on March 7, 2013, and pled guilty to superseding information that charged him with assault by striking, beating, and wounding. The maximum penalty upon conviction is six months in custody, a $5,000 fine, restitution, and a $10 assessment to the Victim Assistance Fund.
The conviction stems from a gang fight that occurred on April 24, 2010 at Bullhead, South Dakota, between the Little Eagle family and their supporters and the White Eagle family and their supporters.
The investigation was conducted by the Federal Bureau of Investigation and the Bureau of Indian Affairs, Standing Rock Agency. The case is being prosecuted by Assistant U.S. Attorney Mikal Hanson.
A presentence investigation was ordered, and a sentencing date was set for May 30, 2013. The defendant was remanded to the custody of the U.S. Marshals Service pending sentencing.
